Penetapan Pengadilan Agama Limboto Kelas 1B (Studi Dispensasi Nikah Tahun 2018-2019)

Abstract

The aim of this research is to eplain the basis for rejecting marriage dispensation at Limboto Religious Court Of Class 1B in 2018-2019. This research is a library research with descriptive-analitical method. As well as using qualitative juriducial-normative approach, this research gained data from primary and secondary resoures. The primary data was the determination of marriage dispensation at the Limboto religious Court of Of Class 1B, while the secondary data source was the marriage constitution. Based on the results of the research, it can be concluded that in the determinations of marriage dispensation in Limboto Religious Court Of Class 1B, there weal several consideration of the judges before rejecting a stipulation based on the trial evidences submitted by the applicant and the facts on the trial submitted. In gaining legal findings, the judges use law interpretation method. Thi is proven that the decision given by the judge is based on the law.
