Analisis Alternatif Penyelesaian Tindak Pidana Anak Dengan Mewujudkan Keadilan Subtantif

Abstract

Child crime is generally an imitation of adult behavior that he often sees, because
physically a child still has poor reasoning power to distinguish good or bad things
from his actions. Due to the nature and circumstances inherent in the child, it
requires special treatment and protection. Substantive justice is a form of justice that
emphasizes moral and cultural considerations of society and overrides rigid formal
legal procedures. The formal procedure for resolving child crimes to realize
substantive justice can be carried out in two ways, namely, restorative justice and
diversion. Factors that cause criminal acts committed by children: lack of embedded
religious spirit, psychology, lack of parental love and care, economy, children's
social environment and the flow of globalization in the field of communication and
information. Child crimes that are rampantly occurring must be the attention of all
parties and can be addressed wisely both from the parents, the community, legal
officials and the government. Law enforcement officials are required to be wiser in
seeing cases where children are the perpetrators, when the crime is considered a
minor crime and the coaching process is considered more effective in rehabilitating
children's behavior.
